If you are an undocumented immigrant or a person without legal status who does not have papers proving your presence or legal residence, you may have asked yourself some of the following questions: Can I get a driver's license if I am undocumented? In which states of the United States can I apply for a driver's license? If I am stopped for driving a car and I do not have a driver's license, can I be deported? Why does it matter to have a driver's license in the United States?

Having a driver's license allows you to legally operate a vehicle in the United States. For many migrants, the ability to drive means improving their quality of life and also their safety.

Among the advantages for migrants to be able to drive a car in the United States are the following:

1. Security.  If an undocumented immigrant is detained and does not have a driver's license, they could face legal and immigration consequences that can range from a fine, vehicle confiscation, to arrest. Although lack of a license is not considered a serious crime, in some cases it can increase the risk of being deported.
2. Access to services.  In some states, your driver's license can be used to open a bank account or to contract a utility service at home.
3. Avoid legal and financial problems.  Having a license allows you to drive legally without the fear of being stopped, fined and/or arrested for driving illegally and having to pay for an attorney.
4. Access to employment.  Obtaining a license will help you expand your job opportunities by being able to travel to a job whose daily distance would be difficult to cover without the ability to legally drive a car. You will be able to access areas where there is greater demand for work and that are not close to your home.
5. Improve your quality of life.  Having the ability to drive a vehicle means saving time on daily activities such as commuting to work, buying groceries, or picking up your children from school. Obtaining a driver's license also makes it easier for undocumented immigrants to access entertainment activities, such as visiting recreational places such as beaches and lakes, which is a positive way to be part of your community.

Licenses in each state

Driving privileges for undocumented immigrants are different depending on each state, some allow short-term licenses and others issue restricted licenses. In some states the license is also considered an identification document.

Are the requirements the same in all states?

The answer is no. The required documents and the process to process the license vary depending on the state in which you want to process it.

However, most states share some requirements, which are as follows:

1. Identity proof.  Verify your identity using identification such as: a valid passport, consular document, such as your DNI, original birth certificate or certificate, border crossing card, marriage certificate or divorce decree.
2. Proof of residence.  Verify that the undocumented person requesting the license lives in the state in which the license is being processed. Some examples: bank statement valid for less than one year, IRS documents, an ITIN or Tax Identification Number. The ITIN also has other advantages for the undocumented.
3. Driving and knowledge exam.  In all states, the applicant is required to pass an exam to obtain a driver's license. In some states it is theoretical and practical. Some states allow the applicant to avoid the road test if they meet certain requirements, such as completing a driver's education course or when they already have a driver's license from a different state in which they want to apply. In states like California, the DMV provides resources in Spanish to help you prepare before taking the test.

Translation of documents for licenses

Keep in mind that most states will require you to When you present a document in Spanish or any other language other than English, it is accompanied by a certified translation, here you can consult the details.

The following are the 20 states in which undocumented people can apply for a driver's license in the United States without having to prove their immigration status.

California

The California DMV allows undocumented immigrants who cannot provide proof of legal residency but who meet other requirements to obtain an AB 60 driver's license.

The documents you must present:

1. Identity proof.
2. Verify that you reside in the state of California.
3. Pass a traffic knowledge test, a practical test for first-time driver's license applicants, and a vision test.

At the DMV offices in California you can also apply for the Real id , which in addition to serving as a driver's license, allows you to board flights within the US, enter federal buildings and military bases. (Since being documented in the US)

According to California law, no one can discriminate against a holder of such a license, nor use it to question the holder's immigration status.

Colorado

Since 2014, undocumented immigrants have been allowed to obtain a driving permit in the state of Colorado under the Colorado Road and Community Safety Act, as long as they meet the rest of the requirements indicated by the Colorado DMV.

However, this type of license is issued with the legend NOT FOR FEDERAL PURPOSES (you cannot vote or apply for federal benefits). It is accepted within the state of Colorado as an identification document. 

Documents that will be requested from you:

1. Identity proof.
2. Verify that you reside in the state of Colorado. You will need to submit two.
3. Taxpayer identification number, also known as ITIN.
4. Pass knowledge and practical driving exam.

As proof of identity, the original valid passport and consular identification card, such as the Mexican consular registration, are accepted.

To prove residency in Colorado, the IRS tax return, current lease contract, bank account statement, among others, are accepted.

Connecticut

Another state that grants a driver's license to undocumented immigrants is Connecticut. Immigrants who are in this state illegally can apply for a "Drive Only" license.

License requirements

1. Verify identity with two forms of identification
2. Prove that you are a resident of the state of Connecticut

To identify yourself, you must present your valid passport or a consular document. And an additional document from the list that you can review in the Connecticut DMV website.

As in most states where undocumented immigrants can obtain a driver's license, it is required that the documents you present in Spanish or in a language other than English be accompanied by an official translation so that the DMV officer can receive and approve them.

License for undocumented immigrants in Delaware

Since 2015, undocumented immigrants who reside in the state of Delaware and who meet the requirements indicated by the DMV can apply for a driver's license under the Driving Privilege Card (DPC) scheme. which is valid for 4 years to drive within the state. It is not a document that is valid as identification.

The first step to apply for a Driving Privilege Card is to contact the Delaware State Bureau of Identification (DSBI), which will ask for your fingerprints and identification document. They do this to verify that the undocumented person applying for a driver's license does not have criminal information in Delaware. After verifying that she does not have a criminal record, they will give her a SBI receipt  in which you are assigned a date to appear at the DMV.

Documents that will be requested from you:

1. SBI receipt.
2. Verify tax payment in Delaware for the last two years.
3. Verify identity and date of birth of the applicant.
4. Two proofs of Delaware residency.
5. Vision exam.
6. Theoretical and practical driving exam.

Undocumented immigrants who apply for the license can present a valid passport as proof of identity. For Mexicans, the voting credential from the National Electoral Institute (INE) is also accepted.

Proof of residence: bank statement, credit card statement, house or apartment lease, among others.

The fee to pay for the Driving License Card is $20 dollars, the validity is 4 years. You must also consider the fee of $52 dollars that the SBI charges for the receipt process.

District of Columbia in Washington  DC

Undocumented immigrants residing in Washington State can apply for a driver's license at the Department of Licenses (DOL) as long as they meet all requirements.

Requirements to be able to process the license:

1. Verify your identity and date of birth using one of the documents accepted by the DOL
2. Sign an Affidavit or Affidavit that you do not have a social security number (ssn). This is provided by the DOL when you come to the office.
3. Pass theoretical and practical driving knowledge exam
4. Get an eye exam

The Washington State DOL has a system of 4 lists with different options and combinations of documents that it accepts so that undocumented people can verify their identity for their driver's license process.

Important: The current passport is taken as the only document to prove identity as long as it has the DHS entry stamps to the United States.

If your passport does not have the stamps proving your legal entry into the US, you have other options. For example, Mexicans can present their Mexican consular registration plus the voting credential from the National Electoral Institute (INE). Salvadorans who do not have entry stamps to the USA in their passport may present their Unique Identity Document plus their Salvadoran birth certificate.

Pre-apply

In Washington, the DOL offers the ease of completing a driver's license pre-application application and driver's knowledge test online, without having to travel to a DOL office to complete these first steps. For subsequent steps, such as taking the driving test and submitting your original documents, you will be asked to appear in person at a DOL office.

Licenses for undocumented immigrants in Hawaii

Since 2016, the state of Hawaii has issued driver's licenses to those who can provide satisfactory proof of identity and residency in the state of Hawaii in accordance with DMV requirements and regardless of their immigration status.

Illinois

The driver's licenses that undocumented immigrants can access in Illinois are called Temporary Visitor Driver's License (TVDL).

There are two types of TVDL: 1- For those who have authorization to reside in the country for one or more years. They must have at least six months of authorized presence at the time of application. 2- It is for people who do not have legal status but who lived in the country for at least one year.

This means that if the person is undocumented, they can obtain a TVDL. And if she has legal immigration status, he can ask for it too.

They will ask you:

1. Prove residency for at least 1 year in the state of Illinois.
2. Provide a valid passport or consular identification.
3. Pass theoretical and practical exam on road knowledge and driving.
4. Vision test.

As of July 1, 2023, undocumented people who reside in the state of Massachusetts and who meet the requirements established by the Registry of Motor Vehicles (RMV) will be able to process a driver's license.

Requirements

This is what is known so far about the requirements that will be asked of you

1. Two valid proofs of identity
2. Two proofs of residency in the state of Massachusetts
3. Letter from the Social Security Office

To identify yourself, you can present a valid passport, consular registration, birth certificate or certificate, marriage certificate, among others. The letter from the Social Security Office is a document that certifies that the applicant does not have a Social Security number in the United States (Social Security Number, SSN), which must be processed 60 days in advance of the date on which is requesting its license.

Minnesota

Thanks to approval of the bill "Driver's Licenses for All" means undocumented immigrants in Minnesota will be able to obtain a driver's license that will allow them to legally drive in the state starting October 1, 2023.

Requirements

La Minnesota Division of Motor Vehicles indicated that it will need to update its list of the types of documents that applicants must show to prove their identity when applying for a license.

It is assumed that applicants must prove their identity and that they are Minnesota residents through, for example, an energy bill or rent receipt.

It is anticipated that applicants will need to demonstrate that they have lived in the state of Minnesota for at least 60 days in order to apply for a driver's license.

Nevada

Since 2014, in the state of Nevada there has been the possibility for undocumented immigrants who cannot meet the identity proof requirements for a license or identification card to apply for a Driver Authorization Card or DAC (Driver Authorization Cards). if they meet the rest of the requirements determined by the Nevada DMV.

To apply for a DAC in Nevada you will be asked:

1. A document that proves your identity.
2. Translation of documents that are not in English.
3. Verify that you reside in the state of Nevada.
4. Pass the theoretical and driving exam. You will also be asked for an eye exam.

The Nevada DMV accepts a valid passport as proof of identity. It does not accept certificates or birth certificates.

As proof of residence, you can present a rental receipt for a house or apartment that is in the name of the applicant, a bank statement.

These cards allow the bearer to drive, but are invalid as identification to apply for other benefits, to board a plane or to enter government buildings.

New Jersey

Since May 2021, undocumented people can apply for a driver's license in New Jersey by verifying their identity, age, and residency with the New Jersey Motor Vehicle Commission (NJMVC).

Documents you must submit to the NJMVC

1. Check identity
2. Proof of New Jersey residency
3. ITIN number
4. Affidavit or Sworn Declaration that you do not have an SSN
5. Traffic knowledge test and driving test

System of points

As in New York, New Jersey has a system in which the undocumented person applying for a license must present identification documents that add up to 6 points. Each of the ID document options has a value determined by the NJMVC. For example, if the undocumented person presents the original, valid passport, it already counts for 4 points, an original birth certificate is also worth 4 points.

As proof of residence you must present 1 document, for example a housing lease agreement, an email received from any local, federal, state or government agency in the last 6 months, any letter or refund received from the IRS or any office of state tax from the year prior to which the driving license is being processed, among others.

New Mexico

After some modifications in the law, undocumented immigrants residing in New Mexico can now apply for a standard driver's license in the state of New Mexico at the New Mexico MVD. Standard license means it is not a REAL ID.

Requirements:

1. Proof of identity and age
2. Two proofs of residency in New Mexico
3. Written road knowledge exam
4. Driving and vision test

The New Mexico Motor Vehicle Division (MVD) accepts the Taxpayer Identification Number or ITIN Number, a valid passport and the consular registration as identification documents. As proof of residence, among others, bank or credit card statements dated less than 60 days old, housing lease contract, official documents issued by a government agency, a state or a federal organization indicating that the applicant resides in New Mexico.

New York

Under Green Light Law , undocumented immigrants residing in New York can apply for a standard driver's license or a driver's learner's permit, also known as Learners Permit  It is not required to be American citizens and your immigration status is not reviewed.

In the Big Apple state, the license applicant must:

1. Prove your identity
2. Verify that you are a New York State resident
3. Accredit the exam

System of points

To prove your identity, the DMV uses a point system, where each type of document has a value. You must collect 6 points in total to be a candidate for a driver's license. For example, presenting a consular document earns you 4 points, the border crossing card is worth 3 points, and a valid passport will add 4 points.

Proof of residence: bank statement with issue date less than 1 year old, credit card statement, lease contract for a house or non-commercial apartment.

Important: In the US, only immigrants who have a work permit issued by the Department of Homeland Security (DHS) can apply for a Social Security Number (SSN). Undocumented immigrants who do not have an SSN must present a  Affidavit or sworn statement to be able to process a driver's license. Another alternative they have is to present a letter of ineligibility  for the Social Security Number.

Oregon

As of January 2021, Oregon residents over the age of 18 do not need to provide proof of immigration status or citizenship to obtain a driver's license. They also do not need a social security number (SSN).

Documents that the Oregon DMV will ask for

1. Proof of identity
2. Proof of residency in the state of Oregon
3. Knowledge test, vision test

As proof of identity you can present your passport, if it has expired and is not more than 5 years old. A school certificate and original birth certificate are also accepted.

Undocumented migrants meet the requirements and obtain their driver's license, they will be able to drive legally but it will also serve as an identification document within Oregon. It is not useful for federal purposes, that is, you cannot board flights within the United States by presenting your license and you cannot apply for federal benefits.

The Oregon DMV offers for people who do not know how to write, an audio version of the theory test in Spanish.

The driving test can be at the DMV office or at one of the authorized driving schools. There is a considerable price difference between doing it at the DMV or at a private school. Take this into account for your budget.

Utah

Thanks to the SB 227 law, Undocumented Immigrants who reside in Utah and who cannot prove their legal presence in the United States can apply for a Driving Privilege Card, also known as Driving Privilege Card  (DPC). These licenses are valid for one year, at the end of which you must renew it to continue driving legally within the state of UTAH.

The documentation you must submit to obtain this type of license, also known as a Limited Duration License (DLD), for the first time:

1. Identification document
2. Submit two proofs of residency in the state of UTAH
3. Submit an ITIN Number
4. Complete a traffic safety exam
5. Pass a written traffic knowledge exam
6. Pass an eye exam

To verify identity, the applicant's current passport and birth certificate are accepted.

Undocumented people over 19 years of age are not required to pass a driver's education exam, but they must present one of the following three options:

• present a driving privilege license from another US state.
• complete a driver's education course or;
• Choose a 90-day learner's permit and add 40 hours of driving with at least 10 hours after sunset.

Vermont

The State of Vermont issues a Driver Privilege Card to residents who meet the requirements but cannot prove their legal status in the United States.

Requirements that you must present at the DMV:

1. Proof of identity
2. Verify you are a Vermont resident
3. Pass the written exam and the driving test.

You can use your valid passport or your consular registration. If you have a certified birth certificate, it can also be used to process your license.

Virginia

In 2020, a law was passed that allows the Department of Motor Vehicles (DMV) to issue Driving Privilege Cards for undocumented immigrants in the state of Virginia.

Thanks to this law that came into force later, undocumented people can apply for a license to drive legally without having to prove their immigration status in the United States, as long as they meet the requirements.

In order to obtain the license they will ask you:

1. Two proofs of identity with date of birth
2. Verify that you reside in Virginia
